 Anniversary Conference titled “35 years of Transformation in the Hong Kong Trust Industry”, where he addressed recent jurisprudential developments in the private wealth and trust sphere and practical perspectives on common issues encountered by trustees in the administration of trust.

SRC International (Malaysia) Limited v Bank Julius Baer & Co Ltd

 [2026] HKCFI 3903, the Court dealt with 3 interlocutory applications arising from a US$112m 

claim linked to the 1MDB saga. The plaintiff claims that it was defrauded by various conspirators, including the former Malaysian Prime Minister, and contends that the defendant bank should have refused to act on 16 payment instructions said to be tainted by “red flags”.

The Plaintiff sought expert evidence on banking practice, specific discovery of internal bank documents, and the Defendant sought further and better particulars of the pleaded fraud. Eugene Fung J dismissed all three summonses.
