[2026] HKCFI 275, a firm of solicitors sought to recover unpaid fees from a former client, which had remained unpaid following a 13-day trial in which the former client’s claims against a Mr Li Fei Yu (Mr Li), relating to the management of the company (WDI), were dismissed and a substantial costs order made against him: [2022] HKCFI 3579.

The firm obtained default judgment against their former client for unpaid legal fees, and further secured a receivership order over the client’s shares in WDI. In an effort to recover the unpaid fees, a partner of the firm – acting as receiver – presented an unfair prejudice petition against Mr Li to compel Mr Li to buy out the former client’s shares. At issue was whether a receiver had locus to present an unfair prejudice petition as receiver. The Court (DHCJ Alan Kwong) held that:
