Lord Sales, Deputy President of the Supreme Court of the United Kingdom, delivered the latest lecture in the HKU-Temple Chambers Law Lecture Series on 24 September 2026.

The Role of Equity in the Law of Contract

”, the lecture addressed the distinct moral foundations of contract law and Equity, and how the two interact. The opening remarks were delivered by Professor Hualing Fu, Dean of the HKU Faculty of Law, and

The Honourable Mr Justice Eugene Fung, Judge of the Court of First Instance of the High Court and a former member of Temple Chambers, moderated the lecture.

China Evergrande Group (中國恒大集團) (In Liquidation) v Hui Ka Yan (許家印) 

[2026] HKCFI 5079 a challenge arose to the authority of solicitors purportedly acting for Mr Hui, ex-Chairman of the China Evergrande Group.

The key issue was whether the general authority of Mr Hui’s solicitors to defend against the Plaintiff’s action included specific authority to pursue certain summonses on costs and relief against an unless order against Mr Hui. Following Mr Hui’s initial general instructions to defend the action, the solicitors had lost contact with Mr Hui upon his detention on the Mainland, following which Mr Hui was barred from dealing with his assets and discussing the same with anyone.

On want of authority, the Court held that:

The decision underscores that a solicitor’s general authority to act in litigation may be subject to limits with regard to particular circumstances and/or steps, and that acting beyond such limits may personally expose solicitors to the risk of a wasted costs order.
